Employers Are Required To Notify Employees by October 1, 2013 About Health Insurance Exchanges Under the Affordable Care Act

The Affordable Care Act (ACA) (also known as Obamacare) requires employers to provide all current employees and new hires with a written notice about ACA’s Health Exchanges no later than October 1, 2013.  There are specific requirements as to the content of the notice to be provided to employees and the manner in which this information is to be provided to employees.

Below are links to two model notices issued by the DOL to be used by employers depending on whether or not the employer offers a health plan to at least some of its employees. These notices include the content required by DOL, but also have sections which need to be completed by some employers under “How Can I Get More Information” and “Health Coverage Offered By Your Employer”  in order to meet the content requirements. Current employees must receive the appropriate notice by October 1, 2013. New hires must receive a similar notice within 14 days of hiring.
